Mr. Zhang has been focusing on dispute resolution in commercial and financial fields for many years. He specializes in commercial and financial legal issues such as contracts, company, securities, funds and insurance. With a solid theoretical foundation and rich practical experience, he is familiar with arbitration and litigation procedures, has a deep understanding of the adjudication of arbitral tribunals and courts, and is good at analyzing difficult cases with complex legal relationships. Representative cases
▪ Represented a financial institution investor in an arbitration case against a private equity fund manager for breach of duty of suitability and duty of loyalty and due diligence. The case achieved damages of RMB 92 million, and became a groundbreaking case in the financial management industry.
▪ Represented a director of a company whose business license had been revoked but not liquidated in the retrial of a liquidation liability dispute against the company’s creditors. Under the unfavorable condition that the director had already been held jointly and severally liable to the creditors for the company’s debts of over RMB 100 million and that the judgment had already entered into force, the case was successfully overturned through the retrial process, dismissing all claims of the company’s creditors against the client and exempting the client from liability.
▪ Represented a multinational electrical group in a second instance case for joint and several liability against the debtor’s beneficial owner and affiliated companies. The debtor’s beneficial owner and affiliated companies, by transferring the debtor’s assets, infringed the client’s right. The amount in dispute exceeded USD 360 million. The case, which involves cutting-edge issues of corporate law such as reverse and horizontal piercing of the corporate veil, is being heard by the Supreme People’s Court.
▪ Represented a leading export credit insurance company in a number of insurance contract disputes in the China International Economic and Trade Arbitration Commission and the Beijing Arbitration Commission. Various hot-debated issues in insurance disputes have been covered, including third-party fraud. All cases achieved satisfactory results.
▪ Represented a well-known Korean logistics group in a Supreme People’s Court case against a well-known Korean cosmetic company over a dispute concerning cooperative investment and share transfer. The amount in dispute was up to RMB 100 million.
