The partners leading Hui Zhong's criminal-civil intersection practice previously served as deputy division-level prosecutors at the Beijing People's Procuratorate, with work experience at both the Supreme People's Procuratorate (SPP) and Beijing First Intermediate People's Court. Their dual expertise in civil and criminal matters enables comprehensive case handling. The team has completed the Research Series on Criminal-Civil Intersection Legal Issues, covering all categories of intersectional legal problems, which has garnered widespread professional recognition. Our partners were the only private practitioners involved in drafting relevant judicial interpretations on this subject for both the Supreme People's Court (SPC) and SPP. In 2022, the team was selected for the SPC's Major Judicial Research Project, producing a 100,000+ Chinese character research report that received extensive acclaim.
Hui Zhong's Criminal-Civil Cross Proceedings practice primarily focuses on financial sector cases.
- Representative cases
- Represented a Shenzhen-based asset management company in ten contract dispute cases against a bank, involving a total amount of RMB¥ 3.8 billion. Our team conducted in-depth analysis of the transaction structures (including trust plans and asset management plans) and criminal-civil intersection issues, accurately identified regulatory trends and key dispute points, and developed multidimensional solutions from both commercial and legal perspectives. Ultimately, we achieved case resolution through mediation and withdrawal of lawsuits, successfully recovering the client's full losses.
- Represented a financial exchange affiliated with a major state-owned enterprise in first-instance proceedings at the Shenzhen Intermediate People's Court against a large commercial bank. Despite obstacles including parallel criminal investigations impeding civil proceedings and jurisdictional challenges raised by the counterparty, our team prepared specialized research reports on criminal-civil intersection issues to persuade the court to proceed. Through coordinated litigation strategies and commercial negotiations, we secured a favorable settlement result that fully meets the client's objectives.
- Represented a state-owned enterprise (as an intermediary) in retrial proceedings against an e-commerce company regarding financing trade disputes, securing complete dismissal of all claims and reducing client losses by over RMB¥ 350 million. This complex case involved issues of forged seals, apparent agency, and evidentiary effect of criminal investigation records.
- Represented a state-owned defense enterprise in a sales contract dispute with an aerospace company involving forged seals, contract fraud, and bulk commodity financing trade issues. We successfully challenged jurisdiction and obtained dismissal of all claims against our client.
- In 2023, represented a provincial branch of Agricultural Bank of China in a wealth management mandate dispute against a property management company. Despite an unfavorable prior judgment from the provincial high court, we secured complete dismissal of all claims in both first and second instance proceedings for the bank. The case involved criminal-civil intersection issues including seal forgery by bank executives and illegal fundraising activities. [Case No. (2023) E01 Min Zhong 8745]
- From 2021 to 2023, represented an Agricultural Bank of China sub-branch in loan contract disputes against individual borrower Xu et al. After taking over the case following first-instance defeat, we achieved complete victory with second-instance reversal dismissing all claims and subsequent rejection of retrial application, reducing client losses by over RMB¥ 200 million. This precedent-setting case addressed cutting-edge legal issues including financial sector criminal-civil intersection and apparent agency disputes. [Case Nos. (2023) Gan Min Shen 104, (2021) Gan Min Zhong 671]
- In 2023, represented a financial institution in enforcement proceedings for a financial loan contract exceeding RMB¥ 1.2 billion, where the collateral was seized in a related criminal case involving RMB¥ 55.6 billion and over 100 victims. Affected by the SPC's "Three Suspensions" notice, this case established important precedents in criminal-civil intersection asset disposition.
- In 2021, represented China Minsheng Bank in second-instance and retrial proceedings before the Supreme People's Court regarding bill rediscounting contract disputes with Ningbo Bank. This landmark case addressed pioneering legal issues concerning transaction nature determination, fault attribution and liability allocation in multi-chain bill financing involving criminal-civil intersection. [Case No. (2020) Zui Gao Fa Min Zhong 26]
- In 2021, represented a state-owned materials company as fund provider in financing trade disputes against a state-owned transportation company. Despite complete first-instance defeat on both claim and counterclaim, we achieved ultimate victory through second-instance and two retrial proceedings, recovering over RMB¥ 60 million in losses. The case involved criminal-civil intersection issues including bill fraud. [Case No. (2021) Jing 02 Min Zhong 197]
