Notes on the Growth of Dispute Resolution Lawyers: March Forward While Reflecting, Progress While Gaining Insights

2018年11月19日,是我在团队实习的第一天,也是我开启争议解决律师职业生涯的日子。犹记得当时正值北京初冬,雾霾笼罩、天气阴沉,但前来报道时我的心情却好似被阳光包裹。诚然,对于一个正处职业选择焦虑的研二学生来讲,能够在机缘巧合下提前收到彼时争议解决“北极星”律所抛来的橄榄枝,无疑是一件极其幸运且自豪的事情,我与争议解决的羁绊自此开始。

自2018年至今,我在争议解决的道路上已前行7年有余,虽然在2023年8月经历了执业平台变化,但新老东家相似的价值观、培养理念以及团队本身的稳定性,让我的律师成长路径并未过多受到负面影响。借助“汇仲文化”栏目,今天不谈专业问题,我想聊聊做争议解决律师的那些事儿。

November 19, 2018 marked my first day interning with the team and the official start of my career as a dispute resolution lawyer. I still recall the early winter haze shrouding Beijing that day, yet my heart was brimming with sunshine. As a second-year postgraduate student tangled in career anxiety, I felt incredibly fortunate and proud to receive an offer from what was widely regarded as a top-tier firm specializing in dispute resolution ahead of graduation. This was where my bond with dispute resolution practice began.

More than seven years have passed since 2018. Though I switched firms in August 2023, the consistent values, training philosophies and stable team culture shared by my former and current employers barely disrupted my professional growth trajectory. Writing for the Hui Zhong Culture column, I will set aside technical legal analysis and share real experiences of working as a dispute resolution lawyer.

争议解决律师的成长轨迹

根据史蒂芬·柯维在《高效能人士的七个习惯》中提出的“成熟模式图”,人类的成长可划分为依赖期(以“你”为核心)、独立期(以“我”为核心)、互赖期(以“我们”为核心)三个阶段,与此相类似,在成为管理型/案源型合伙人(要更多考虑品牌建设、律所管理、市场开拓等商业事务,不在本文讨论的法律事务范围内)以前,争议解决律师在业务层面的成长亦可大体划分为三个阶段:

首先是初级律师阶段(1-2年级,包含入职前的实习期)。初级律师在团队协作过程中主要负责材料梳理、案件汇报、法律检索、会议/庭审准备及记录、问题清单/案件进展报告/程序性文书起草等工作,根据律所及团队需求不同,亦可能在案件处理以外承担一定的课题研究及学习分享工作。在初级阶段,律师应着重培养自身的法律研判及事实梳理(相较于对案件材料的规整、对核心事实的归纳,更重要的是事实挖掘以及从客观事实到法律事实的构建)技能,前述两项技能是支撑一名争议解决律师承办处理疑难复杂案件的重要根基。如果想要快速成长、早日蜕变为成熟律师,初级律师应保持对争议解决的好奇心,“多看,多想,多参与”,我的案件研判能力即得益于从业初期高频率、多类型的案件评估。

其次是中级律师阶段(3-4年级)。中级律师在团队协作过程中主要负责分析意见及各类诉讼/仲裁文书的撰写工作,另因从业2年后基本均已取得律师执业证,中级律师通常要开始参与庭审甚至主责简单案件的庭审工作。在中级阶段,律师应有意进行角色转变,从初级阶段的任务“执行者”转变为问题“解决者”,不再满足于完成合伙人及资深律师交办的任务,在案件承办期间要更多地发挥主动性,以案件主要负责人的身份要求自己,多从纠纷解决角度考虑问题,包括在案件磋商阶段如何呈现我们的代理优势、赢得客户认可?如何根据客户需求把控案件推进节奏?在什么节点提交什么文件?如何说服裁判者接受我方观点?等等。

最后是资深律师阶段(5年级及以上)。资深律师在团队协作过程中主要负责统筹把握案件推进的全流程,包括但不限于确定案件代理方向、审核把关各类拟交付客户/裁判机构的法律文书,以及与客户/裁判机构的对接等。因合伙人要将精力更多投入市场开拓、团队建设等方面,在业务层面,资深律师要有意成为案件处理的终极负责人,为合伙人减负。除了继续精进法律研判、文书写作、庭审表达等根基性的执业技能外(争议解决是一个专业性极高的行业,除非有强大的资源网,摒弃业务能力的律师在任何时候都不可能走远走稳),资深律师要强迫自己从案头工作中跳出来,以更宏观、更高层级的视角看待问题,逐渐完成从“法律技术工”到“项目管理者”的转变。如果说初/中级律师的关注重点在研究透彻每一个问题、写好每一份文书、开好每一次庭,资深律师要更多思考如何做赢一个案子,以及如何以专业服务获取客户信赖、增强客户粘性、树立行业地位。

以上仅是对争议解决律师成长轨迹的一般概括,因律所工作模式、个人情况不同可能有所区别。“每一朵花都有自己的花期,每个人都有自己的人生轨迹”,无论你的争议解决律师成长轨迹如何,在自己的节奏里保持前进就好。

The Growth Trajectory of Dispute Resolution Lawyers

Drawing on the Maturity Continuum outlined in The 7 Habits of Highly Effective People by Stephen Covey, human growth falls into three phases: Dependence (centered on "you"), Independence (centered on "I"), and Interdependence (centered on "we"). Similarly, before advancing to management or client-originating partners (who devote much energy to brand development, firm administration and business development—topics outside the scope of legal practice discussed here), dispute resolution lawyers generally go through three career stages in terms of case work.

Stage 1: Junior Lawyer (Year 1–2, including internship)

Junior team members are primarily tasked with sorting case materials, delivering case briefings, conducting legal research, preparing and taking minutes for meetings and hearings, drafting issue lists, case progress reports and procedural pleadings. Depending on firm and team arrangements, they may also conduct research projects and internal knowledge-sharing sessions outside case work.

At this stage, lawyers must hone two core capabilities: legal assessment and factual analysis. Beyond organizing documents and summarizing core facts, the priority lies in digging deeper into hidden facts and constructing legal facts based on objective evidence. These two competencies form the bedrock for handling complex, high-stakes disputes.

To accelerate growth and mature quickly, juniors ought to stay curious about dispute resolution work, observing more, thinking more and participating more. My own capacity for case evaluation was built through frequent assessments of diverse matters in my early career.

Stage 2: Mid-level Lawyer (Year 3–4)

Mid-level lawyers take charge of drafting legal memoranda and all types of litigation and arbitration submissions. Having obtained their practicing certificates after two years in practice, they usually start attending court hearings and even lead trials for straightforward cases.

This stage demands a clear shift in mindset: moving from a task executor to a problem solver. Rather than merely finishing assignments delegated by partners and senior lawyers, mid-level counsel must take initiative, act as the lead handler of each case, and evaluate matters from a dispute resolution perspective. Key questions to consider include: How to demonstrate our firm’s strengths and win client trust during settlement negotiations? How to pace case progress in line with client demands? What documents should be submitted at each procedural stage? How to persuade adjudicators to adopt our arguments?

Stage 3: Senior Lawyer (Year 5 and above)

Senior lawyers oversee the full lifecycle of cases, including defining overall litigation strategies, reviewing all legal documents to be submitted to clients or tribunals, and liaising with clients and judicial/arbitral authorities. With partners focusing more on business development and team building, senior practitioners serve as the ultimate point of accountability for case work and ease partners’ workloads.

Apart from refining foundational skills such as legal analysis, drafting and courtroom advocacy (dispute resolution is an extremely specialized field; without robust professional capabilities, no lawyer can sustain long-term success, regardless of personal connections), seniors must step back from desk work and adopt a broader, higher-level perspective, transforming from legal technicians to case project managers. While juniors and mid-level lawyers focus on resolving individual legal issues, polishing documents and delivering strong hearings, seniors must prioritize devising holistic winning strategies, securing long-term client loyalty and building a reputable standing within the industry.

The above only outlines a general developmental path, which varies based on each firm’s workflow and individual circumstances. Every person grows at their own pace, and steady progress on your own timeline matters most.

争议解决律师的执业技能

根据2025年9月司法部公布的信息,我国现有律师约83万人。执业群体庞大,但优质案源有限,若要在数十万律师中脱颖而出,除了依托强大的律所平台、进行必要的BD外,更关键的是培养过硬的执业技能。即使客观条件完全相同的案件,因代理律师的专业度不同,也可能出现截然相反的案件结果。争议解决律师在执业过程中,应持续夯实、优化以下基本技能:

首先是体系化的法律分析能力。体系化的法律分析能力具体体现在三个方面,一是逻辑思维能力,能否快速厘清交织的法律关系,能否在混乱复杂的案件事实中准确识别关键信息,主要体现的即是逻辑思维能力的不同,虽然逻辑思维能力如何在很大程度上取决于先天条件,但亦可通过后天训练不断加强;二是法律检索及研判能力,通俗来讲就是我们在人员招聘时关注的法律功底及法感觉,在人工智能时代下,AI可以帮你快速梳理目标问题涉及的法律规范、参考案例,但如何基于个案情况从中选择可适用的法律规则、可匹配的类案仍有赖于律师个人的研判能力,尤其在客户诉求不可行的情况下,如何为客户提供其他替代性解决方案或救济路径,需要律师动用整个法律体系、通过制度联动拟定综合方案;三是法律事实构建能力,如上述,能否将客户提供的案件材料、介绍的背景信息快速梳理清楚并不足以区分律师能力,更为关键的是能否基于客观事实及法律规则构建出将直接影响案件走向的法律事实,我们不能寄希望于裁判者从散落的客观事实中择取对我方有利的法律事实,事实构建需要在发表具体法律观点前先行呈现。

其次是简洁有力的表达能力。归根结底,争议解决律师从事的是一项说服工作,案件磋商阶段说服客户选择我们,案件代理阶段说服裁判者采纳我方观点。鉴于客户未必熟悉法律专业,而裁判者时间又颇为有限,要求律师无论在书面还是口头表达时都应当力求精准、简洁,以最简短有力的语句表达最关键的内涵。在文书写作时另须注意区分受众,以读者为本位。对客户而言,因其关注的是如何实现对自我权益的维护/救济,文书要落脚于具体诉讼/答辩方案,如果案件本身确有风险,在提示风险的同时要尽量提供风险控制或解决方案;对裁判者而言,因其关注的是双方核心观点是什么、有没有事实及法律依据,文书要落脚于我方观点的呈现,为方便裁判者参阅,可考虑在陈述各项观点的基础上列明对应的证据及法律依据/类案,在案件复杂、文书篇幅确实难以压缩的情况下,建议将各级标题作为目录或在开篇以摘要的方式提炼、强调核心观点,以便引起裁判者重视。

最后是对法律外事务的学习能力。案件源于商业实践,在具体个案处理过程中,通常会涉及其他行业问题,如果要清晰呈现我方观点、因地制宜地拟定解决方案,争议解决律师不可避免地要了解透彻相关专业问题,这要求优秀律师要具备对法律外事务的学习能力。例如,在以资产交易为目的的股权转让纠纷中,可能涉及资产评估、审计等问题,需要律师掌握相关财务概念及运行逻辑;又如,在客户本身处于油气供应等特殊行业的案件中,需要律师掌握相关业务运营模式。此外,洞察社会及经济发展趋势,择取适当的行业进行实务观察,也有利于向目标客户群体呈现我们在特定领域的专业性及问题解决能力,为获取潜在案源奠定基础。

Core Professional Competencies for Dispute Resolution Lawyers

Official data released by the Ministry of Justice in September 2025 shows China has around 830,000 licensed lawyers. The profession is vast, yet high-quality mandates remain scarce. To stand out among thousands of peers, alongside leveraging a strong firm platform and conducting business development, lawyers must cultivate impeccable core capabilities. Two attorneys may secure completely opposite outcomes even handling identical cases, purely due to gaps in professional proficiency. All dispute resolution practitioners should continuously refine and strengthen the following fundamental skills.

1. Systematic Legal Analysis

This ability covers three dimensions:

First, logical reasoning. It governs one’s capacity to untangle intertwined legal relationships and pinpoint critical information amid chaotic factual records. While logical thinking is partly innate, consistent training can significantly sharpen it.

Second, legal research and case evaluation. This reflects a lawyer’s legal grounding and intuitive legal judgment. In the AI era, artificial intelligence can rapidly sort relevant statutes and precedents, yet only human lawyers can select applicable rules and matching case authorities tailored to unique factual backgrounds. When a client’s claims lack legal support, lawyers must draw on the full legal framework to design alternative remedies and comprehensive solutions.

Third, construction of legal facts. Simply organizing materials provided by clients cannot distinguish top-tier practitioners. The key skill lies in shaping legal facts that directly determine case results from objective evidence and legal provisions. We cannot rely on adjudicators to extract favorable legal facts from scattered records; fact construction must be laid out clearly before advancing substantive legal arguments.

2. Concise, Persuasive Communication

At its core, dispute resolution practice revolves around persuasion: convincing clients to retain our services during consultations, and persuading tribunals to endorse our arguments during litigation or arbitration. Since clients lack legal expertise and adjudicators face tight time constraints, both written and oral submissions must be precise and concise, conveying core viewpoints in the most impactful wording possible.

Drafting must also cater to different audiences:

For clients, documents should center on concrete litigation or defense strategies, clearly outlining risk control measures and alternative solutions while flagging potential downsides. Clients care foremost about protecting and recovering their legal interests.

For adjudicators, submissions must highlight our core arguments paired with supporting evidence, statutes and precedents. When cases are highly complex and lengthy filings unavoidable, use hierarchical headings as a roadmap or open with an executive summary to emphasize key viewpoints and capture judges’ attention.

3. Cross-industry Learning Aptitude

Disputes arise from commercial operations, so case handling frequently involves specialized knowledge from other sectors. To articulate arguments clearly and design targeted resolutions, outstanding dispute resolution lawyers must quickly master relevant industry expertise.

For instance, equity transfer disputes structured around asset sales require familiarity with asset appraisal and auditing principles; cases involving clients in oil and gas supply demand understanding of their operational models. Additionally, tracking social and economic trends and building insights into specific industries helps demonstrate professional expertise to potential clients and creates opportunities for new mandates.

从业多年的些许感悟

第一,扎实“业务能力”+适当“诉讼技巧”是决胜的王牌。在任何场景下,扎实的业务能力(主要体现在法律功底及事实挖掘两个方面)永远都是赢得胜利的根基,但律师的角色定位毕竟有别于裁判者,帮助当事人解决问题而非对系争纠纷作出公正处断的立场导向,决定了律师要同时善用诉讼技巧妥善化解纠纷,对于争议解决律师而言,在事实挖掘及法律研判基础上通过系统性的方案协助当事人实现商业目标,远比取得一纸结果意义上的胜诉判决/裁决要更为重要。

以我们近两年处理的案件为例:(1)在一宗我方诉请对方交付股权的案件中,因标的股权有质押登记,基于当时的法律事实想要获得胜诉基本是不可能的,此种情况下,我们没有囿于对“股权质押不影响股权交付”的论证,而是寻求从根源上直接解决股权质押问题,先是通过策略性地提起衍生诉讼(诉请确认股权质权消灭)获悉标的股权质押担保的主债务情况,然后基于《民法典》项下的第三人代为履行制度代偿前述主债务,借此为股权交付扫清障碍;(2)在一宗对方(土储中心)基于房源被第三方占用诉请解除房屋订购协议、我方(房地产企业)返还购房款的案件中,除结合举证责任及实体法规定从多角度进行系统答辩外,我们通过对原始材料的详尽梳理精准识别到了关键证据(相关材料事实上是我们在代理客户处理其他纠纷时拿到的,由此也可印证案件材料管理及全面消化的重要性),据此说服法官认可系争房源分配问题应在政府内部解决,并推动对方在首次开庭后主动撤诉;(3)在一宗我方诉请法院撤销自规局闲置土地收回决定的案件中,虽然系争土地在形式上可能确已符合闲置2年的收回条件,但基于对案件事实以及闲置土地相关行政案例的系统梳理,我们直接指出自规局在作出收回决定时的重大程序问题,法院最终以“违反法定程序”为由判决撤销土地收回决定。

上述案件的赢面在评估初期其实都不算大,我们能够取得胜诉结果,离不开业务能力及诉讼技巧的双重作用。如果没有扎实的业务能力,无法快速从朴素杂乱的客观事实中准确识别并构建出对案件走向有直接影响的法律事实,为裁判者支持我方主张提供事实及法律依据;如果不能善用适当的诉讼技巧,在面对代理困境暨所谓的“法律不可行”时就只能束手无策,无法突破重围、寻求转机。

第二,接纳代理结果的不完美。在刚拿到律师执业证不久,我曾收到过一份最高法院的败诉判决。该案涉及股东出资责任问题,因原审判决客户在认缴出资范围内对股权转让前的公司债务承担补充清偿责任,我们代理客户向最高法院提起上诉,最高法院经审理最终维持原判。也许因为是第一次以代理人身份承办最高法院案件,又或因从最初的接洽评估到案件代理,我个人确实对该案投入了极大精力,在获悉败诉结果的那一刻,我情难自已地崩溃大哭。现在回想当时的情况,在为自己执业初期的“纯粹”感慨之余,更多是对我们应如何面对败诉判决/裁决的反思。“人非草木,孰能无情”,在代理结果不达预期时,负面情绪涌现实属正常,但相较于“表达情绪”,更重要的是从情绪内耗中抽离,接纳代理结果的不完美并“解决问题”。收到败诉判决/裁决后,不妨进行如下体系性思考:

首先,在法律程序上是否还有救济路径(例如,能否继续提起上诉、申请再审/执行监督/撤裁等)?如果尚有救济路径,应在审慎评估改判可能性及诉讼成本的基础上拟定后续工作方案供客户决策;若已无救济路径,或经评估改判可能性极小,亦应结合客户实际需求提供应对方案(例如,在客户因资金周转困难暂无法偿付债务时,能否通过推动与对方达成执行和解等方式延缓执行、避免核心资产被立即处置?在客户基于合同约定不得不承担责任的情况下,能否基于其他法律关系或请求权基础另行提起诉讼/仲裁,帮助客户挽回损失?)。

其次,败诉的原因是裁判者在证据采信/事实认定/法律适用方面有问题,我们的证据收集/代理策略不完备,还是案件的基本面决定了我方基本不可能胜诉?从我们过往参与评估或公开查询到的案件看,即使在高层级法院,也存在论理及裁判结果有失妥当的情况,此即司法固有的局限性。如果是裁判者在事实认定(包括对证据的采信、对举证责任的分配等)或法律适用上有问题,自然应当以提起上诉、申请再审/执行监督等方式向上级法院寻求救济,还是要对我国整体的司法环境抱有信心,与其斥责抱怨原审法院的不公,更应将精力尽快投入救济程序;如果代理律师自身对案件事实的挖掘、对关键证据的收集不到位,或在法律研判方面存在漏洞,则属于严重的工作失误,在尽可能采取补救措施(若尚能争取二审/再审改判,或另行提起其他诉讼挽回损失等)的基础上,我们应当痛定思痛、深刻反思代理失误的原因,并以此为戒、在后续的职业生涯中杜绝再出现类似问题。此外,争议解决的两造构造决定了案件必有输赢,法律作为社会学科并非纯粹的逻辑演绎,而是包含一定的政策考量,如果在现行法律体系及司法导向下,客户的诉求或主张原本即难以获得支持,则不必为败诉结果过分伤怀,换个角度想,裁判者基于双方诉辩情况最终作出合法合理的公允处理,又何尝不是法律职业共同体的幸事呢?在上述提及的股东出资责任案件中,最高法院即是在股东及公司债权人之间对后者利益做了倾斜保护,相关处理精神也与2023年修订后的《公司法》第88条规定相符,即使没有取得结果意义上的胜诉判决,只要我们在代理过程中竭尽全力、问心无愧即可。

第三,做一名有“态度”的律师。虽然我本人不是讨好型人格,但在从业初期尤其是刚开始主办案件的时候,因为经验不足、对自我认知不够坚定,曾经做过一段时期“对客户有求必应,对裁判者刻意迎合”的讨好型律师。“讨好”不是一个绝对的贬义词,作为法律服务提供者、法律观点说服者,争议解决律师在面对客户、裁判者时天然处于低位,地位的不完全平等决定了“讨好”“迎合”在一定程度上是律师获取客户信任、实现代理目标的保护色。但争议解决是一个专业性极强、有门槛的行业,如同医生治病救人,争议解决律师的核心目标及作用亦是解决问题、救济权益,因此在纠纷解决过程中我们要树立主人翁意识,把控案件推进的主导权,视情况做一名有“态度”的律师。一方面,相较于听话乖巧、有求必应的律师,理性客户更需要的是能够帮其真正解决问题的律师,“硬实力”才是获取案源、增强客户粘性的关键,因为律师是以时间及精力提供服务,在无效事项上投入的时间及精力过多必然会影响对其他事务的处理,面对客户提出的对案件代理结果无益的要求,我们可以基于当前的工作安排视情况拒绝,以便保障主要精力能够用于对案件推进真正有价值的事情;另一方面,或因受到审判压力、畏难情绪、法外因素等影响,裁判者在案件处理过程中可能会时常出现拖延推诿、不合理打断律师发言甚至对双方当事人进行不公允对待,迎合并不能让裁判者作出对客户有利的处理,在重申我方诉求无果的情况下,我们可以适当表现出强硬态度,以详实的论证理由及坚定的表达推动裁判者重视我方合理诉求。

第四,允许自己在低谷时重启人生。“高精力”“胜负欲”“对抗性”应当是外界对争议解决律师的典型画像,但庭审中的慷慨陈词以及电脑前的奋笔疾书不可能是一名争议解决律师的永恒状态(更何况,本身是“低精力人群”,但秉持着对法律的热爱毅然坚守在争议解决一线岗位的律师朋友并不少见),受制于生理及心理状态的影响,争议解决律师陷入低谷的情况可能会时有发生,我自己在从业多年后也曾有过迷茫、倦怠,想要逃避甚至离开律师行业的阶段。大到职业发展,小到日常工作,出现瓶颈或陷入低谷并不可怕,不必为此过于焦虑,关键是如何进行自我调整,逃离情绪漩涡。前段时间网络上有个非常火的话题——“洗澡是重启人生的最小单位”,背后折射的正是当代成年人在高压生活中对情绪调节与低成本自救的普遍需求。

我们要允许自己处于低谷,允许自己在低谷时重启人生,面对工作带来的高压和碎片化的生活,我们可以选择按下“重启键”以期获得心理复位。因此,如果在案件研判时思路阻塞、在文章写作时灵感枯竭,去洗个澡重启大脑吧!如果今天工作状态不佳、身心疲惫,去睡个觉重启一天吧!“睡觉”其实是我在工作中最常采取的重启方案,放过今天的自己,第二天被清晨阳光唤醒的,也许就是那个已经恢复满满斗志、身心畅快、思维敏捷的你。即使是职业发展进入平台期,在深思熟虑的前提下你也可以选择重启人生,另寻他路重新出发!从前一直向前赶路、恐慌时间流逝,但看到身边一个个在30岁时重启人生的鲜活案例,我突然发觉,岁月悠悠,人生漫漫,适时选择正确的方向远好过在错误的道路上奋力打转,做喜欢且适合的事情,任何时间都不算晚,你可以在自己的节奏里前行。

Reflections Gained Over Years in Practice

Solid Professional Expertise Plus Strategic Litigation Tactics Are the Key to Victory

Robust professional grounding—rooted in deep legal knowledge and thorough factual investigation—forms the unshakable foundation of successful representation. However, unlike judges tasked with impartial rulings, lawyers exist to resolve clients’ practical problems, which means we must also deploy strategic litigation techniques to defuse disputes effectively. For dispute resolution practitioners, crafting systematic strategies to realize a client’s commercial objectives carries far greater value than merely obtaining a nominal favorable judgment or award.

Three recent matters illustrate this balance:

A claim for equity transfer was initially deemed unwinnable due to existing pledges on the target shares. Instead of futilely arguing that pledges do not bar delivery, we resolved the root pledge issue: we filed a derivative lawsuit to confirm the extinguishment of the pledge and identify the underlying secured debt, then repaid the debt on the pledgor’s behalf under the substitute performance provisions of the Civil Code, removing barriers to share transfer.

A local land reserve authority sued our real estate developer client to terminate housing subscription agreements and demand repayment of deposits, citing third-party occupation of the properties. Beyond comprehensive defenses grounded in burden of proof and substantive law, exhaustive review of archived materials uncovered pivotal evidence (originally obtained during unrelated client representation). This convinced the judge that housing allocation disputes fell under internal government administration, prompting the opposing party to voluntarily withdraw the suit after the first hearing.

We filed an administrative lawsuit seeking revocation of a land recovery notice issued by the natural resources bureau for idle land. While the land technically appeared to satisfy the two-year idle recovery criteria, systematic research into case facts and relevant administrative precedents exposed severe procedural violations in the bureau’s decision-making process. The court ultimately ruled the recovery notice void on procedural grounds. None of these cases had strong odds of success during initial assessments, and positive outcomes relied equally on solid professional skill and flexible litigation strategy. Without rigorous legal and factual analysis, we could not identify favorable legal facts to back our claims before tribunals. Without strategic tactics, we would be powerless to break deadlocks when a matter appears legally unviable.

Embrace Imperfect Case Outcomes

Shortly after receiving my practicing license, I lost an appeal before the Supreme People’s Court concerning shareholder supplementary liability for corporate debts arising prior to equity transfers. Having invested immense effort throughout the entire representation process, I broke down in tears upon receiving the adverse ruling. Looking back, I cherish the sincere dedication I brought to the matter yet have reflected deeply on how to process unfavorable judgments and awards.

Negative emotions are natural when results fail to meet expectations, yet moving past emotional exhaustion to solve practical problems matters far more than venting frustration. After receiving an adverse ruling, conduct systematic analysis as follows:

First, identify remaining procedural remedies: Can we file an appeal, retrial application, enforcement supervision or setting-aside application for an arbitral award? If avenues remain available, assess reversal prospects and litigation costs to propose follow-up plans for the client’s decision-making. If no viable remedies exist or reversal odds are negligible, formulate tailored solutions aligned with the client’s practical needs: negotiating enforcement settlements to defer asset seizure amid cash flow shortages, or launching separate litigation or arbitration based on alternative causes of action to recover losses where contractual liability applies.

Second, pinpoint the root cause of the unfavorable result: Did the tribunal err on evidence evaluation, factual findings or statutory interpretation? Or were our evidence collection and litigation strategies incomplete? Or was the client’s claim fundamentally weak from the outset?

Judicial limitations mean even high-level courts occasionally issue rulings with flawed reasoning. If the court misapplies facts, evidence or law, pursue appellate or retrial remedies through higher tribunals with faith in China’s judicial system, rather than complaining and wasting energy. If the loss stems from our own oversights in fact-finding, evidence gathering or legal research, take decisive remedial action where possible and conduct thorough self-reflection to avoid repeating the same mistakes in future work.

Furthermore, litigation inherently produces winners and losers, and legal reasoning incorporates policy considerations beyond pure logical deduction. If statutory frameworks and judicial trends make a client’s claim unsustainable, there is no need for excessive distress. A fair ruling balancing both parties’ interests remains a positive outcome for the entire legal community.

In the shareholder liability case mentioned above, the Supreme People’s Court prioritized creditor protection, consistent with Article 88 of the revised 2023 Company Law. Even without a favorable judgment, we could rest easy knowing we exhausted every reasonable effort in representation.

Be a Lawyer With Firm Professional Convictions

I was prone to over-accommodating clients and overly deferential to adjudicators in my early independent case work, lacking solid self-confidence from limited experience. While the term “accommodating” is not purely negative—legal practitioners naturally occupy a subordinate position when persuading stakeholders, and appropriate deference helps build trust and advance representation goals—dispute resolution is a highly specialized profession analogous to medicine: our core mission is resolving disputes and protecting legal rights. Lawyers must take ownership of matters, retain control of case progress and uphold clear professional convictions when appropriate.

On one hand, rational clients prioritize lawyers who deliver tangible solutions over compliant ones. Professional expertise is the most reliable driver of client retention and referrals. Wasting excessive time on requests that bear no impact on case outcomes diverts energy from high-value work, so we may politely decline such demands based on workload.

On the other hand, adjudicators may delay proceedings, interrupt submissions unreasonably or treat parties unfairly due to trial pressure, hesitation or external factors. Excessive deference will not secure favorable rulings for clients. If restating our legitimate claims fails to elicit a fair response, we may adopt a firmer stance supported by thorough legal arguments to ensure the tribunal attaches weight to our reasonable positions.

Allow Yourself to Hit Reset When You Hit Rock Bottom

The public stereotype of dispute resolution lawyers paints us as high-energy, competitive and combative, constantly delivering impassioned courtroom arguments or drafting legal documents late into the night. In reality, many practitioners have naturally low stamina yet persist out of passion for legal work. Everyone experiences burnout, confusion and even the urge to leave the profession at certain career stages, including myself after years of practice.

Career bottlenecks and slumps are nothing to fear; the critical skill lies in emotional regulation to escape cycles of negativity. A widely discussed online concept frames “taking a shower” as the simplest way to hit life’s reset button, reflecting the universal need for low-cost emotional relief amid high-pressure modern work.

We ought to permit ourselves to struggle and embrace opportunities to reset. When blocked on legal analysis or drafting, pause and refresh your mind. If worn out with low energy, sleep to reset your whole day. Sleep is my most frequent reset method: let go of one day’s burdens, and you may wake the next morning sharp, energetic and clear-headed. Even if your career hits a plateau, you may choose a full reset after careful deliberation and embark on a new professional path.

I once rushed blindly forward, anxious about passing time, yet seeing peers reinvent their careers in their thirties taught me this: life is long, and choosing the right direction beats fruitless struggle down the wrong road. Progress at your own pace, and it is never too late to pursue work you love and excel at.
