Through in-depth investigation and reasonable organization of evidence, despite an unfavorable judgment on related facts in another case, we helped the client achieve a complete victory in this case.   • In 2023, Represented a commercial bank in a property damage compensation dispute case with a dispute subject exceeding 1 billion yuan, which was the first case of electronic bill infringement in China, involving issues of criminal and civil intersection such as whether the bill intermediary constitutes fraud, and the determination of fault and responsibility in the bank's provision of bill agency access process. We joined the case after the client lost the first instance and successfully obtained a second instance to change the judgment to the other party's fault liability.
  • In 2023, Represented a state-owned securities company in a dispute over an asset management contract at the China International Economic and Trade Arbitration Commission, dealing with the arbitration request for institutional investors to compensate for the principal and interest of the investment, involving issues such as bankruptcy isolation of asset securitization products with fee income rights, and the appropriateness of the manager's obligations and the boundary of diligence. Ultimately, we helped the client successfully reduce the loss by more than 150 million yuan and achieved the client's arbitration goals.
  • In 2023, Represented an investment company and fund under one of the four major asset management companies in a contract dispute case, involving typical issues such as the effectiveness of the bet agreement, the obligation of the original shareholders to make up the shortfall for investors, and the determination of the guarantee liability when the debtor and the guarantor are the same. After partially losing in the first instance, we successfully fought for the Beijing High Court to send back the second instance and achieved a complete victory in the retrial of the first instance at the Beijing Second Intermediate Court.
  • In 2023, Represented a well-known real estate company in a contract dispute with a real estate development company in Beijing, involving the effectiveness of the land primary development entrustment contract. We achieved a victory in the first instance at the Beijing First Intermediate Court, and recovered more than 100 million yuan of debts for the client, achieving the client's litigation goals.
  • In 2023, Represented Beijing Dongya Real Estate Development Company in a real estate development cooperation contract dispute with a state-owned construction company.   • In 2022, Represented a provincial branch of a state-owned bank in a wealth management contract dispute case, involving issues of a private bank president illegally absorbing public deposits in the name of wealth management, and the bank's external responsibility. Under the situation where the provincial high court had made an unfavorable judgment on similar series cases, we Represented the client to win the case in the intermediate court, and applied for prosecutorial supervision to the provincial procuratorate for the provincial high court case, and obtained the result of requesting the Supreme Procuratorate to file an appeal.
  • In 2022, Represented a state-owned military enterprise in a sales contract dispute with an aerospace company, involving issues of criminal and civil intersection such as forging seals and contract fraud, and financing trade issues of bulk commodities.   • In 2022, Represented Minsheng Bank, China Construction Bank in handling a series of disputes over false statements of responsibility in interbank bond cases, dealing with the prosecution of institutional investors. The case involved typical and difficult issues of the same type of disputes, such as the boundary of the intermediary institution's burden of proof, the determination of causality, and the issuer's suspected fraudulent issuance.
  • In 2021, Represented a city branch of a state-owned bank in a loan contract dispute with four natural persons. The case was a financial institution involving criminal and civil intersection, involving the determination of the bank staff's official actions and apparent agency. After the client lost the first instance, we joined the case and successfully obtained a complete victory in the second instance, dismissing all the other party's litigation requests, and reducing the client's loss by more than 200 million yuan.   • In 2021, Represented Minsheng Securities in a dispute over corporate bond transactions, involving typical issues of securities disputes such as the determination of joint litigation, the distinction between entrusted management responsibility and false statement responsibility, and the determination of losses of junk bond investors.   • In 2011, Represented a state-owned military enterprise and its subsidiary in a sales contract dispute with a Jiangsu e-commerce company, involving issues of criminal and civil intersection such as the determination of the "bridge party" responsibility in financing trade disputes, the determination of apparent agency, and the evidence effect of forged seals and public security investigation records.   • In 2020, Represented natural persons Zheng and Pan in a dispute over a share transfer contract with another natural person, Guo, and a real estate development company in Shanxi. We participated in the retrial and second instance proceedings at the Datong Intermediate Court and the Shanxi High Court. This case was a highly watched bet dispute case following the issuance of the "Minutes of the National Court Civil and Commercial Trial Meeting". The effective judgment was the first to directly respond to the controversial issue of whether the target company's guarantee for the transfer of shares between shareholders is valid, recovering about 200 million yuan in losses for the client.   • In 2019, Represented the Northern Navigation Technology Group Co., Ltd. in a lease dispute with Beijing Jinlin Hotel Management Co., Ltd., involving issues of the dissolution and compensation for loss of property lease contracts when a large-scale property is divided by the lessee and "sold by lease" to a third party. We joined the case after the client's comprehensive loss in the second instance, applied for a retrial to the Supreme Court, and achieved a retrial instruction from the Beijing High Court, and a comprehensive reversal in the retrial first and second instances at the Beijing High Court, recovering a large amount of property for the client.   • In 2017, Represented China Export & Credit Insurance Corporation in a property insurance contract dispute with a foreign trade company, appealed to the Guangdong Provincial Procuratorate and facilitated the institution to appeal to the Guangdong High Court. The case involved cutting-edge legal issues such as the effectiveness of the first action exemption clause, and we ultimately successfully obtained a court reversal and preserved the effectiveness of the clause, which was regarded by the Export & Credit Insurance Corporation as a "case that the entire industry will remember".   • In 2018, Represented Haining China Leather City Co., Ltd. in an investment contract dispute with Xinxiang Tianxi Real Estate Co., Ltd., involving a subject of about 70 million yuan. We appealed to the Henan High Court, and in the case of a comprehensive loss in the first instance, we achieved a comprehensive reversal in the second instance through solid evidence collection work, and ultimately facilitated the other party's agreement to mediation, resolving the company's deadlock.
