Mr. Fei is the managing partner of Hui Zhong Law Firm, a boutique dispute resolution law firm based in Beijing, Shanghai, Shenzhen, Singapore and Hong Kong. He has represented both Chinese and foreign clients in hundreds of commercial arbitration and litigation cases before domestic and overseas arbitral tribunals as well as PRC courts at various levels including the Supreme People’s Court. He is one of the few lawyers who has practical experience of investment arbitration disputes in China. Currently, he is representing multiple investors in ICSID proceedings. He has also provided expert opinions on Chinese law in various forums in Hong Kong, Singapore, the United Kingdom and the United States. Since 2006, Mr. Fei has been ranked as Band 1 lawyer in the fields of arbitration and general dispute resolution in China by Chambers & Partners Asia Pacific. He is described by Chambers & Partners as “a seasoned litigator and is admired for his high standard of professionalism. He excels in providing efficient, sensible commercial advice.” Mr. Fei is an arbitrator at Chinese and international arbitration institutions, including China International Economic and Trade Arbitration Committee (CIETAC), Shenzhen Court of International Arbitration (SCIA), International Court of Arbitration of the ICC (ICC Court), Hong Kong International Arbitration Centre (HKIAC), Singapore International Arbitration Centre (SIAC), and Korean Commercial Arbitration Board (KCAB). He is also a member of SCIA Advisory Committee. During 2013 - 2019, he was a Council Member of HKIAC, a title vested to persons from mainland China for the first time in history.
International Investment Arbitration Disputes and International Commercial Arbitration Disputes
- Represented a British investor in an international bilateral investment treaty arbitration against an Asian sovereign state, involving the expropriation issue due to the revocation of the British investor’s land use rights certificate. The case used UNCITRAL Arbitration Rules and was conducted at the Permanent Court of Arbitration (PCA) in The Hague, with the amount in dispute exceeding US$ 300 million.
- Represented a Chinese investor in submitting a negotiation request under a bilateral investment treaty to an Asian sovereign state. The amount in dispute exceeds US$ 300 million.
ICC (International Chamber of Commerce) Arbitration
- Represented a Chinese automobile manufacturing company in handling a dispute with an Egyptian company arising from a CKD project contract. The amount in dispute exceeds US$ 120 million.
HKIAC (Hong Kong International Arbitration Centre) Arbitration
- Represented a large state-owned insurance company in initiating arbitration at HKIAC under UNCITRAL Arbitration Rules, requiring a globally renowned insurance company to assume reinsurance liability, with the amount in dispute reaching tens of millions of euros.
- Represented a Chinese pharmaceutical enterprise in handling a dispute with another Chinese pharmaceutical enterprise arising from a drug distribution agreement, with the amount in dispute exceeding RMB 400 million.
- Successfully represented a Chinese company in handling a dispute with a Japanese company arising from an international sale of goods contract, with the amount in dispute approximately RMB 240 million.
- Represented a listed company and global leading pump manufacturer in handling a procurement contract dispute with a Chinese buyer, with the amount in dispute nearly RMB 100 million, obtaining a complete victory award.
- Represented a technology and creative paper manufacturer in handling a dispute arising from a specialty paper production joint venture contract, with the amount in dispute RMB 170 million, ultimately helping the client obtain a complete victory award in the case.
SCC (Stockholm Chamber of Commerce) Arbitration
- Represented a famous American natural gas power company and a famous American international investment company in handling a dispute with a power company in Hainan Province arising from a concession agreement for investment in a gas-fired power plant, with the amount in dispute US$ 110 million. Huizhong successfully achieved a settlement result highly satisfactory to the client before the case entered the arbitration proceedings.
CAS Sports Arbitration Disputes
- Represented a Chinese world swimming champion in handling an arbitration case at the Court of Arbitration for Sport (CAS) in Switzerland regarding a doping violation claimed by the World Anti-Doping Agency; cooperated with a Swiss lawyer team to successfully annul the previous unfavorable arbitral award made by the Court of Arbitration for Sport at the Swiss Federal Tribunal; subsequently achieved a revised judgment in the re-arbitration proceedings, shortening the suspension period by half.
CIETAC Arbitration
- Represented a listed company as the equity transferee in handling a dispute nominally for equity transfer but actually for mining rights transaction, with the amount in dispute exceeding RMB 1 billion, currently under hearing.
- Represented a former executive of a listed company in handling an equity dispute with the actual controller of the listed company, with the amount in dispute RMB 600 million, currently under hearing.
- Represented a well-known real estate company in handling a land development dispute with a local enterprise, with the amount in dispute RMB 400 million, currently under hearing.
- Represented a foreign enterprise in handling an iron ore sales dispute with a Chinese state-owned enterprise, with the amount in dispute exceeding RMB 100 million, currently under hearing.
- Represented a large local state-owned enterprise in handling an equipment sales contract dispute with a central state-owned enterprise, with the amount in dispute exceeding RMB 500 million, concluded with a result satisfactory to the client.
- Represented a local government in handling a highway concession contract dispute with a Hong Kong company regarding a project company established in the mainland, with the amount in dispute exceeding RMB 4.5 billion; after Huizhong represented the client in responding, the opposing party withdrew the lawsuit.
- Represented a foreign investment fund in handling an equity transfer dispute with a high-end catering enterprise in China, including parallel handling of interim measures in Hong Kong and Singapore and CIETAC arbitration proceedings, with the amount in dispute nearly US$ 300 million, obtaining a complete victory.
- Represented a large gas supply enterprise in handling a gas supply contract dispute with a gas user, with the amount in dispute nearly RMB 200 million, obtaining a complete victory.
- Represented a Singaporean enterprise in handling an international trade dispute with a domestic Chinese company, with the amount in dispute RMB 120 million, obtaining a complete victory.
- Represented an internet giant company in handling an equity transfer dispute with a well-known domestic liquor enterprise, with the amount in dispute RMB 2 billion, resolved through settlement with a result satisfactory to the client.
SHIAC Arbitration
- Represented a Taiwan-funded enterprise in handling a dispute with the Yangzhou Municipal Government regarding land development and government subsidies under an investment framework agreement, with the amount in dispute exceeding US$ 110 million, resolved through settlement with a result satisfactory to the client.
SCIA Arbitration
- Represented an institutional investor in handling a breach of asset management contract dispute with the asset management plan manager, with the amount in dispute exceeding RMB 160 million, achieving a preliminary victory and successfully holding the manager liable for compensation for investment losses due to failure to fulfill due diligence obligations.
- Represented a wholly foreign-owned enterprise in China of a well-known Japanese equipment manufacturer in handling two sales contract dispute cases, with the combined amount in dispute exceeding RMB 1.3 billion, obtaining a complete victory.
- 2015-2017 Wang Shengchang and Fei Ning published reports in Global Arbitration Review (GAR) - Asia Pacific Arbitration Review 2015 China Chapter for 3 consecutive years.
