Profile

Wang He is currently the Deputy Secretary-General of the Professional Committee on Enforcement Behaviour of the Chinese Society of Behavioural Law. He has experience in trial and enforcement work at the Supreme Court, High Court and Basic Court. He participated in the drafting of the Draft Law on Civil Enforcement, and drafted a number of judicial interpretations on enforcement, such as equity enforcement, change and addition of enforcement parties, enforcement settlement, enforcement guarantee, property investigation, etc. He has handled hundreds of enforcement cases, such as enforcement implementation, property preservation, enforcement review, enforcement supervision and other types of enforcement cases.

Representative Cases

Enforcement, Collection, and Preservation

  • Represented a listed company in an enforcement case against a real estate group and an individual. Despite the enforcement judge's initial order to close the case due to no available assets, leveraged enforcement settlement and guarantee mechanisms to secure the court's approval for disposing of newly provided collateral, enabling the client to fully recover over RMB 80 million in claims within 50 days.
  • Acted for a financial leasing company in enforcing against a local state-owned enterprise. By establishing the location of the assets as the jurisdictional connecting point, circumvented local protectionism and successfully recovered the entire claim of over RMB 40 million.
  • Assisted a client in securing a preservation order over antiques, paintings, and calligraphy, which ultimately facilitated a settlement, allowing the client to fully recover RMB 20 million in claims.
  • Represented an asset management company in an enforcement case against a listed company. Within two weeks of taking over the case, secured travel and consumption restrictions against the de facto controller of the judgment debtor.

 

Enforcement Review and Coordination

  • Represented a Hong Kong company in an enforcement appeal against an individual and others before the Supreme People's Court. The appeal grounds were fully upheld by the Court.
  • Acted for a real estate company in an enforcement reconsideration case before the Henan High People's Court. The court revoked the previous objection ruling, recovering losses of over RMB 50 million for the client.
  • Represented a steel company in an enforcement supervision case before the Hebei High People's Court. The supervising court annulled the reconsideration and objection rulings, creating a procedural pathway for the client to pursue subsequent claims.
  • Acted for a real estate group in an arbitration award enforcement case brought by a trust company. Successfully secured the removal of dishonesty and consumption restrictions against the group's de facto controller.
  • Represented an asset management company in an enforcement case against a conglomerate. Within ten days, successfully transferred the priority disposition right for the first-sealed assets from an intermediate court in Western China to an intermediate court in Guangdong.
  • Within two days, completed the freezing of cross-provincial claims; within two weeks, obtained a court ruling to substitute the client as the enforcement applicant, achieving the client's objectives for an enforcement settlement.

 

Litigation

  • Prevailed in the second-instance trial of a dispute over a distribution scheme. The appellate court overturned the first-instance judgment, affirming the client's entitlement to participate in the distribution of RMB 100 million in claims.
  • Obtained a first-instance judgment in favor of a financial institution in a subrogation claim against the bankruptcy administrator of a real estate company. The effective judgment averted losses of RMB 36 million for the client.
  • Secured appellate victories for a pharmaceutical company in two separate cases: a RMB 97 million unjust enrichment claim and a RMB 70 million private lending dispute.
  • Represented a high-net-worth individual in multiple disputes arising from an inheritance, including inheritance, mortgage, and equity-related claims. Prevailed in all cases, enabling the client to regain a 20% equity stake in a real estate company.
